Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Finn Digital LLC, the operator of Troth ("Finn Digital", "Troth", "we", "us", or "our"), covering your use of the Troth iOS app and related services (the "Service"). They also serve as the app's Terms of Use and End User License Agreement (EULA). Please read them carefully, especially the disclaimers about what Troth does and does not do.

Troth is a per-regulator compliance recordkeeping, scheduling, and reminder tool for independent convenience-store and gas-station owners. It helps you keep checklists and checks, temperature readings, schedules, corrective actions, an audit log, legal-hold records, and tamper-evident evidence photos. Troth is a tool that records what you enter and capture. It is not legal, regulatory, tax, or professional compliance advice, and it does not guarantee any inspection, audit, regulatory, or legal outcome.

Read this first. If you do not agree to these Terms, do not use the Service. By creating an account or using Troth, you accept these Terms and our Privacy Policy. Sections covering disclaimers, limitation of liability, and indemnification limit our responsibility and assign certain responsibilities to you, so they matter.

1. Acceptance of Terms

Troth is operated by Finn Digital LLC, a Florida limited liability company ("Finn Digital," "we," "our," or "us"). These Terms of Service ("Terms") form a binding agreement between you and Finn Digital LLC governing your use of the Troth application and related services (the "Service").

By downloading, accessing, or using Troth, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you are using Troth on behalf of a business or other entity, you represent that you are authorized to accept these Terms for that business, and "you" refers to both you and that business.

These Terms also incorporate Apple's standard End User License Agreement for applications licensed through the App Store. Where Apple's standard EULA conflicts with these Terms, the more protective terms for you, as applicable under Apple's rules, will apply to that conflict.

3. License

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Troth app on Apple devices you own or control, solely for your internal business compliance recordkeeping. This license does not transfer any ownership of the Service to you.

You may not, and may not permit others to: copy, modify, distribute, sell, lease, or sublicense the Service; reverse engineer, decompile, or disassemble the app except to the extent that restriction is prohibited by law; remove or alter any proprietary notices; or use the Service to build a competing product. We may revoke this license if you breach these Terms.

4. Your Account & Responsibilities

You create an account using Sign in with Apple, Google, or an email address and password. You may use Apple's Private Relay email. We never receive your Apple or Google password. You are responsible for:

5. Subscriptions, Billing & Trials

Troth offers an optional auto-renewable subscription, Troth Plus:

Subscriptions are sold and billed through your Apple Account. Apple processes your payment; we do not receive your card details. By subscribing, you authorize Apple to charge the price plus any applicable taxes to your Apple Account.

Features available without a subscription, and those that require Troth Plus, are described in the app and may change over time.

7. No Legal Advice

Troth is a recordkeeping, scheduling, and reminder tool. It does not provide legal, regulatory, tax, or professional compliance advice and is not a substitute for an attorney, a compliance professional, or your regulators. Nothing in the Service, its checklists, references, or outputs constitutes such advice. For advice about your specific situation, consult a qualified professional or the relevant authority.

8. Your Compliance Responsibility

You are solely responsible for complying with all laws and regulations that apply to your business, including those concerning food safety, fuel and underground storage tanks (UST), tobacco and alcohol, OSHA, and any others. Using Troth does not ensure or guarantee compliance, passing any inspection or audit, or avoiding any fine, citation, penalty, closure, or lawsuit. Troth helps you organize and document your own efforts; the obligation to comply, and the consequences of non-compliance, remain entirely yours.

9. Tamper-Evident, Not Tamper-Proof

The Evidence Vault is designed to make alteration of a stored record detectable: each evidence photo you capture is sealed with a SHA-256 hash in an append-only chain. This makes the Vault tamper-evident. It is not "tamper-proof." We do not guarantee that records cannot be altered, deleted, lost, or corrupted, or that the chain will detect every possible form of tampering. You remain responsible for keeping your own copies of records that matter to you.

Troth produces "legal-ready" documentation, including an evidence manifest, hash-chain verification, and a certification framed around Federal Rules of Evidence 902(13) and 902(14). These features support the authenticity of a record, meaning that it is what it purports to be and is unaltered since capture.

They do not establish admissibility, the weight a court or authority will give a record, or any inspection, audit, regulatory, or legal outcome. Those are decided solely by the relevant court, regulator, or authority. The certification speaks to the integrity of the record, not to the truth of the underlying act it depicts.

We use "legal-ready" to describe documentation that is organized and integrity-verifiable. We do not describe Troth or its outputs as "court-ready," "court-proof," or "guaranteed admissible," and you should not rely on them as such.

11. Accuracy of Your Records

You are responsible for the accuracy, completeness, timeliness, and truthfulness of everything you record. Troth records what you enter and capture; it does not independently verify that a check was performed correctly or that the underlying facts are true. A sealed, integrity-verified record is only as reliable as the information you put into it.

12. General Content

The checklists, cadences, and regulatory references provided in the Service are general starting points, such as federal-floor requirements. They may not reflect all requirements for your jurisdiction or industry, which vary and change over time. You are responsible for confirming the requirements that actually apply to your business and for adjusting your practices accordingly.

13. Not Government-Affiliated

Troth is independent. It is not affiliated with, endorsed by, or acting on behalf of OSHA, the EPA, the FDA, any state alcoholic beverage control (ABC) agency, any health department, or any other regulator. References to such agencies are provided for informational purposes only.

14. No Warranty

The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will meet your requirements or produce any particular result. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

15. Limitation of Liability

To the maximum extent permitted by law, Finn Digital LLC and its owners, officers, employees, and suppliers are not liable for fines, penalties, citations, closures, lost profits, legal or defense costs, settlements, judgments, or any indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of, or inability to use, the Service or any of its records, reminders, or exports, even if advised of the possibility of such damages.

Where a liability cap is enforceable, the total aggregate liability of Finn Digital LLC for all claims relating to the Service shall not exceed the greater of (a) the amount you paid for Troth in the 12 months before the event giving rise to the claim, or (b) US $50. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Finn Digital LLC and its owners, officers, employees, and suppliers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service or your failure to comply with applicable laws and regulations.

17. Termination

You may stop using the Service at any time. You can delete your account in the app at Settings → Delete Account, which deletes your account and associated store data and evidence from our systems, and revokes your Sign in with Apple token where applicable. Records you have explicitly placed under a legal hold are retained until you release the hold, by design, so that evidence under hold is not lost.

We may suspend or terminate your access if you breach these Terms, if required by law, or if continued provision of the Service becomes impractical. Sections that by their nature should survive termination, including the disclaimers, limitation of liability, and indemnification, will survive.

18. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide notice in the app. Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree, stop using the Service and delete your account.

19. Governing Law

These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in Florida will have jurisdiction, except where applicable consumer-protection law gives you the right to bring a claim in your place of residence.
